By placing an order with Asha Sweet Center through our website, mobile application, WhatsApp, telephone, or any third-party delivery platform, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

1. About Asha Sweet Center

Asha Sweet Center is committed to delivering freshly prepared sweets, savouries, snacks, bakery products, meals, beverages, gift hampers, and festive products through our stores and hyperlocal delivery network across Bengaluru.

2. Acceptance of Terms

By accessing our website or placing an order, you confirm that:

• You are legally eligible to enter into a binding contract.
• All information provided by you is accurate.
• You agree to comply with these Terms & Conditions.
• You accept our Privacy Policy and Return & Refund Policy.

3. Electronic Communication

When you place an order, create an account, or contact us via email, SMS, WhatsApp, or any digital platform, you consent to receive communications electronically. These may include order confirmations, delivery updates, OTP verification, promotional offers, festival campaigns, loyalty programme communication, and customer support messages. Such communications satisfy any legal requirement for written communication.

4. Intellectual Property & Trademarks

All content on the Asha Sweet Center website, mobile platforms, social media channels, and other materials, including logos, brand identity, trademarks, taglines, product names, product photographs, menu descriptions, graphics, designs, videos, and other intellectual property, is the exclusive property of Asha Sweet Center or its licensors and is protected under applicable Indian intellectual property laws.

No part of this content may be copied, reproduced, modified, distributed, published, or used for any commercial purpose without prior written consent. Unauthorized use may result in legal action.

5. Customer Account

If you create an account, you are responsible for maintaining account confidentiality, protecting your password, keeping your information accurate, and all activities carried out under your account.

Asha Sweet Center reserves the right to suspend or terminate accounts found to be fraudulent or in violation of these Terms.

6. Hyperlocal Delivery Service

Our hyperlocal delivery service operates within selected serviceable areas across Bengaluru. Delivery availability depends on store operating hours, delivery radius, weather conditions, traffic conditions, local restrictions, and product availability.

Estimated delivery times are indicative only and may vary during weekends, festivals, public holidays, high-demand periods, or due to traffic and weather. Delays beyond our reasonable control shall not constitute grounds for compensation.

7. Fresh Food Policy

Since our products are freshly prepared every day:

• Availability may vary and certain products may sell out without notice.
• Substitutions shall only be made after customer approval.
• Customised products cannot always be modified once preparation has begun.

8. Order Acceptance

Your order is considered accepted only after payment is successfully received, inventory verification is completed, and operational feasibility is confirmed.

We reserve the right to reject or cancel any order due to product unavailability, incorrect pricing, suspected fraudulent activity, service area limitations, operational constraints, or force majeure events.

9. Pricing

All prices are displayed in Indian Rupees (INR). Applicable GST and taxes shall be charged as per prevailing laws. Prices may change without prior notice. During promotional campaigns, only one offer may be applicable unless otherwise specified.

10. Product Availability

All products are subject to availability. Certain products are available only seasonally, during festivals, on pre-order, or in limited quantities.

11. Payment Methods

We accept UPI, Credit Cards, Debit Cards, Net Banking, and Digital Wallets. Payments are processed through secure payment gateways. Asha Sweet Center never stores complete card information.

12. Failed Transactions

In case of payment failure, please retry after confirming payment details. If your account has been debited without order confirmation, the amount is generally reversed by your bank within 5–7 working days. If not reversed, please contact our customer support with the transaction details.

13. Cancellation Policy

Orders once placed cannot be cancelled.

14. Changes to Orders

Orders once placed cannot be modified or changed.

15. Delivery Policy

Customers are responsible for providing the correct delivery address, accurate landmark, active contact number, and ensuring recipient availability.

If delivery cannot be completed because the recipient is unavailable, the address is incorrect, the phone is unreachable, or repeated delivery attempts fail, the order shall be treated as completed and may not be eligible for refund.

16. Delivery Verification

For security purposes, our delivery partner may require OTP verification, recipient confirmation, signature, or a photograph of successful delivery.

17. Returns & Refunds

Due to the perishable nature of our products, food items cannot be returned once delivered. Refunds or replacements shall only be considered in cases of wrong product delivered, damaged product, spoiled product, missing item, or duplicate payment.

Supporting photographs must be shared within 30 minutes of delivery along with the order ID. After verification, Asha Sweet Center may offer replacement, gift voucher, partial refund, or full refund (where applicable). Approved refunds are processed to the original payment method within 5–7 business days.

The final decision remains with Asha Sweet Center. No refunds or replacements will be provided for change of mind, incorrect details provided by the customer, failed delivery due to customer unavailability, improper storage after delivery, or complaints raised after 30 minutes of delivery.

18. Corporate Orders

For corporate gifting, festive hampers, events, weddings, and bulk purchases, advance payment may be required and production timelines shall be mutually agreed. Kindly contact our sales team at sales@ashasweetcenter.com.

19. Festival Orders

During festivals (including but not limited to Diwali, Raksha Bandhan, Ugadi, Ganesh Chaturthi, Eid, Christmas, and New Year), customers may experience longer delivery timelines, limited stock, order cut-off timings, and possible product substitutions (with prior approval). Early ordering is strongly recommended.

20. Promotional Offers

Promotional offers cannot be exchanged for cash, cannot be combined unless stated, are valid only during the specified period, and may be withdrawn at any time without prior notice.

21. Marketing Consent

By registering or placing an order, you consent to receive promotional communications from Asha Sweet Center via SMS, Email, WhatsApp, Push Notifications, and Phone Calls. You may opt out at any time.

22. Limitation of Liability

Asha Sweet Center shall not be liable for delays or failures caused by natural disasters, floods, heavy rainfall, strikes, traffic disruptions, internet outages, payment gateway failures, government restrictions, or events beyond our reasonable control. Our liability shall, in all circumstances, be limited to the value of the affected order.

23. Food Allergies

Our products may contain or come into contact with Milk, Nuts, Peanuts, Wheat, Gluten, Soy, and Sesame.

24. Privacy

Customer information collected during ordering is used solely for order processing, customer support, delivery, billing, and marketing (where consent has been provided). We do not sell customer information to third parties.

25. Governing Law

These Terms & Conditions shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka.
